You may have other rights granted by law, and these Terms of Sale do not affect these except if the two are inconsistent. If this is the case then these Terms of Sale will override any other rights which you may have, unless this is not permitted by law. To purchase from us you must be over 18 and resident in the UK or Ireland.
Once you are ready to make a purchase, click on” add to shopping bag” to add the Product you wish to purchase to your shopping cart. Then proceed by clicking “proceed to purchase “to log into our secure server to complete your Order.
When you have completed your order you will be asked to confirm you wish to make an order and consent to the Terms of Sale. We will then send you a confirmatory email to acknowledge that we have received your email. After sending you this first email we will check to make sure we are able to fulfil your Order. If and when we are able to do so, you will then receive a second email from us confirming your order,confirming dispatch of the product to the delivery address you have requested and giving you estimated timescales for delivery. This is sent out automatically by us to the email address you register with us. At this point we will process the payment details you have given to us to take payment for your Order.
You should check both emails for accuracy and let us know immediately if there are any errors. Your order will be accepted by us when we send the second email to you confirming your order and dispatch of the Product and at this point the contract between us (Contract) is formed. Ownership of the Product will pass to you on delivery. When you submit your order you are offering to buy the Product at the price set out in the Order.
Prices are checked regularly. However, if we find the price has changed or that there has been a pricing error when we receive your order we will contact you and ask if you wish to proceed at the correct price. If you discover you have made a mistake with your order please contact us immediately. We are unable to rectify mistakes after this time, although you still have the right to cancel as described below.
The prices indicated on our Website at checkout include all taxes,including VAT which may be payable in respect of the Product and delivery charges. All payments must be made at the time of dispatch. Payment for all Products must be made by credit or debit card.
For payment by card,all credit and debit cardholders and bank/building society account holders respectively may be subject to authorisation and authentication. If the issuer of your payment card or service provider refuses to, or does not for any reason authorise or validate the payment, we will not be liable in these circumstances for any delay or non delivery in respect of the Product which you have ordered as a result.
We aim to deliver the product to you, to the delivery address you have registered in your Order within the time set out in our shipping times but we cannot give an exact delivery date.
If you change your mind with a Product you may return it to us for an exchange or refund within 14 days of receipt of your order. Please make sure any goods returned are in the same condition in which they were received by you along with all packaging and paperwork that was provided to you. Please use the return label provided. All goods returned for exchange or refund must be sent by Royal Mail Special Delivery or by registered post if posted in the Republic of Ireland. Please include a covering letter with your details and instructions on how you wish to proceed. Please call or email us to inform us that you are intending to return an item. This is for added security and ensures we can process the refund or exchange as efficiently as possible. We aim to process your refund or exchange within 7 working days of receipt of the returned goods. Our registered valuers and gemmologists will test all diamonds that have been returned to ensure authenticity. Refunds will be issued when this process is completed. You will not be permitted to purchase several items of a similar style and value in order for you to keep the one you like best and return the rest. Terms and conditions do not exclude or limit our liability for death or personal injury resulting from our negligence. We shall be under no liability to you for any loss, costs, expenses damage or other claims in respect of any defect in any product purchased arising from your wilful damage, neglect or failure to follow our instructions, any misuse or alteration of the product by you without our prior approval or arising from any information supplied by you which is incomplete, inaccurate, illegible, out of sequence or in the wrong form. We do not guarantee the delivery date specified in the order confirmation and shall have no liability to you for any loss, damage, expenses, costs or other claims that you may incur as a result of late delivery.
In the event that we are unable, or fail to deliver any order within a specified time scale, we will endeavour to contact you to reschedule a new delivery date. We shall not be liable for any failure or delay due to any act of God, war, strike, lockout, industrial action, fire, flood, drought, tempest or any other event beyond our reasonable control.
If you do not receive your order within 30 days of the expected delivery date we notify you of when we confirm your order, we shall have no liability to you unless you notify us in writing of the problem within 40 days of the original order date. These Terms and Conditions shall be governed by Northern Irish Law and shall be subject to the exclusive jurisdiction of the Northern Irish Courts.
